Terms of Service
Last updated October 4, 2026. These terms apply to every order placed with OPTIMIUM NEXUS, LLC ("we", "us") for the Certificate Preflight services described at https://certificatepreflight.com. By placing an order you ("you", the "Client") agree to them.
1. What we do
We prepare product-certificate data for U.S. importers. For each product you send us, we reconcile the certificate (GCC or CPC), the laboratory test reports and the laboratory identifiers against the formats and code lists published by the U.S. Consumer Product Safety Commission (CPSC), and we deliver a gap report, an upload file for the CPSC Product Registry, a broker sheet and an audit trail. The number of products covered, the price and the deliverables of each service are those shown on our pricing page at the time of the order.
2. What we do not do
- We do not test products and we do not issue test reports.
- We do not provide legal advice. Whether a rule applies to a product, and whether a product complies with it, is your decision, with your counsel or your laboratory where needed.
- We do not act as a customs broker and we do not file entries with U.S. Customs and Border Protection.
- We do not certify products. We never submit anything to CPSC or to any authority in your name. You upload the file to your own Product Registry account, review it there and certify it yourself.
3. Your responsibilities
You remain the certifier of your products and are responsible for the accuracy and completeness of every certificate, whether or not it was prepared with our help. You are responsible for the documents you send us, for confirming the extracted data section by section through the person you designate, and for reviewing every deliverable before you use it. A deliverable that has not been confirmed by your designated person is a draft. If we open an account on our platform for a person at your company or for your customs broker, that person is responsible for keeping their password to themselves, and everything done under their sign-in is attributed to them in the audit trail.
4. Documents and automated extraction
The documents you send are used only to prepare your deliverables. To read them, we use an artificial-intelligence model provided through a third-party API (Anthropic). Extracted values are never final: your designated person confirms each of them, and every confirmation is recorded with a name and a time in the audit trail. We keep your documents and data for the duration of the engagement and for up to twelve months afterwards for support purposes, and we delete them earlier on written request.
5. Delivery
Work starts when we have received payment and a complete set of documents for the products ordered. If documents are missing, we tell you what is missing; the time needed to obtain them is not counted in our delivery time. Deliverables are sent by email or through a shared folder to the address you give us.
6. Fees and payment
Prices are in U.S. dollars, exclusive of any tax, and are paid in advance through our payment provider. A Quick Check fee is credited toward a Certificate Preflight ordered by the same Client within 90 days. Because work begins on receipt of your documents, fees are not refundable once extraction has started, except where we fail to deliver.
7. Confidentiality
We treat your documents, product data, supplier and laboratory information as confidential, we do not share them with anyone other than the service providers needed to deliver the work, and we do not use them for any other purpose.
8. Warranties and limitation of liability
We warrant that we will perform the services with reasonable care and skill. Our deliverables are prepared from the documents you provide and from the lists CPSC publishes; we do not warrant that a certificate prepared with our help will be accepted by CPSC, U.S. Customs and Border Protection or any other party, or that a product complies with any rule. To the fullest extent permitted by law, our total liability for any claim arising out of a service is limited to the fees you paid for that service, and we are not liable for indirect or consequential losses, including seized or delayed goods, lost sales, penalties or fines.
9. Governing law
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. Any dispute that cannot be settled amicably will be brought before the courts of Delaware.
10. Changes and contact
We may update these terms; the version in force is the one published at https://certificatepreflight.com/terms on the date of your order. Questions: hello@certificatepreflight.com. OPTIMIUM NEXUS, LLC, 251 Little Falls Drive Wilmington, DE 19808 US.
